These regulations apply to any activity deemed to be “in commerce,” encompassing digital and communication networks involved in interstate or international trade, as interpreted in United States v. Baston, 818 F.3d 651 (11th Cir. 2016). The term “affecting commerce,” as seen in Citizens Bank v. Alafabco, Inc., 539 U.S. 52 (2003), illustrates the broad reach of Congress’s Commerce Clause authority. Promoting services online is considered a commercial act, and thus falls under this scope (Baston, 818 F.3d at 664-665).

As such, any website that knowingly promotes or facilitates prostitution in the U.S. - including the advertisement of individuals based there - may be in breach of federal law.
